A mortgage foreclosure summons is a court document entitled “Mortgage Foreclosure Summons.” It is attached to a copy of the Mortgage Foreclosure Complaint. A Mortgage Foreclosure Summons could have been delivered to you at your home or office by a person or Sheriff. It also could have been left with a relative in your home or a co-worker at your office. You may have also received it through the mail. There are other ways you may have received it as well.

A mortgage foreclosure complaint is a document that a bank files with the Clerk of the Court to start a mortgage foreclosure action in the Circuit Court of Cook County. It is generally titled “Complaint to Foreclose on a Mortgage” or “Mortgage Foreclosure Complaint.”

Any other documents relating to a mortgage foreclosure case will be documents that identify on the first page the following information: The Circuit Court of Cook County, a plaintiff (that is a bank’s name), a defendant(s) (that is your name and other names), and a case number (a number that has a “CH” in it).

Examples of such documents could be: A mortgage foreclosure summons, a mortgage foreclosure complaint, a Notice of Initial Case Management, a Notice of Motion, Motion for Default, Motion for Judgment of Foreclosure, or a Judgment of Foreclosure. There are other documents and these are just examples of common documents in a mortgage foreclosure case.
